Terms of Service
- Dates are reserved only with a deposit of $125 or 20% of package (whichever is higher), which is nonrefundable, paid by cash or credit card. The deposit will apply toward the contracted service. The contracting party must make all cancellations in writing. In the event of cancellation all payments toward the event is non refundable.
- Balance is due seven days prior to the event.
- Once a service is chosen or an order is placed and all necessary payments made, the sale is final and nonrefundable. No verbal changes will be accepted. Any schedule or order changes must be documented, submitted, and signed by the contracting party/ parties and K.C. Photography for confirmation and mutual authorization.
- Images will be available approximately 3-5 day after the event date. Images will be delivered via a transfer site or a USB drive which can be picked up at our studio.
- Federal Copyright Laws preserve the right to exclusive use of digital files, and reproductions of K.C. Photography. K.C. Photography shall only make reproductions for the Client, the Client’s family, friends, or acquaintances, or for the Photographer’s portfolio, sample, self – promotions (website, social media), entry in photographic contest or art exhibitions, editorial use, or for display within or on the outside of K.C. Photography. All photographs are copyrighted. It is illegal to reproduce professional photographs.
- K.C. Photography cannot be held responsible for lack of coverage resulting from weather conditions or schedule complications caused by, but not limited to, anyone in or at the event, or by the event hall restrictions. Due to the fact parties/gatherings are uncontrolled events; we cannot guarantee any specific photograph or pose. We will however attempt to honor special requests. Due to the limited and subjective nature of the event, K.C. Photography cannot predict or guarantee the final photographic results. K.C. Photography does not commit a particular photographer to photograph the event. K.C. Photography warrants that all photographers are competent professionals. K.C. Photography may substitute another photographer to take the photographs in the event of illness or inability to perform. In case of such substitution, K.C. Photography warrants that the photographer taking the photographs shall be a competent professional.
- If K.C. Photography cannot perform this agreement due to a fire or other casualty, act of God, failure of transportation or equipment or other cause beyond the control of the parties, or due to Photographer’s illness, K.C. Photography shall return deposits and/or payments made by the Clients but shall have no further liability with respect to the agreement. This limitation on liability shall also apply in the event the photographic materials are damaged in processing, lost in shipping, or otherwise lost or damaged without fault on the part of K.C Photography. In the event the Photographer fails to perform for any other reason, K.C. Photography shall not be liable for any amount in excess of the retail value of the shoot.
- K.C. Photography is not responsible for any paid orders not placed and/or picked up within 30 days of the event date.
- K.C. Photography is not liable for any damage to digital files beginning 30 days following the event.
